Construction
Legacy Design & Construction, Inc. was established
in 1999. Operating for over 11 years, Mike
Pudlik has over 25 years of experience in the
residential remodeling industry and custom
kitchen/bath
designs. Legacy is a
family owned business, operated by Mike and his wife,
Cindy, serving Cook, Kane and DuPage Counties. Their
three children help with the business on a part-time,
as needed basis. Legacy is a Bertch
Cabinet Dealer, offering five different levels of
cabinetry to meet most budgets. Legacy is also a

Legacy is lead by Mike Pudlik, a Master Certified
Remodeler and Green Certified Professional through the
NARI. Mike volunteers his time to the NARIGC and
serves on the Executive Board and Chairperson for
Programs and Meetings. Legacy generously donates
construction material items to Habitat for Humanity
for the construction needs of under privileged
homeowners. Legacy has also contributed to
local non-profit organizations in the Chicago area
including; church sponsored Father/Son/Daughter
Camps, local girls softball teams, high school
athletic booster clubs, Feed My Starving Children and
Compassion International Ministries with the
sponsorship of a child.

the challenges of renovating a home in Naperville that
was 75+ years old. It had all the
characteristics of an old home; sagging floors,
structural issues and severe energy
inefficiency. The homeowners were a young couple
with one child and their family was about to grow from
3 family members to 5. At the start of the
project they announced that they were expecting twins
and they would need a design that would put all the
bedrooms in close proximity to each other. It
was then decided that a second floor addition would be
designed using the latest techniques and products
available to support their new second floor structure
on their existing home. Their current home
lacked an adequate center support system.
Through careful architectural planning and design, the
new floor system and structural beams accommodated the
deficits of this old house. Latest insulation
techniques and energy efficient windows were used to
create an air tight effect. Half way through the
major renovation project, the homeowners also decided
they needed a kitchen remodel. Just weeks before
the entire project was completed, this Naperville
family welcomed twins into their new home! The
family is very pleased with the results and Legacy
attributes its success on this project to its entire
team of professionals that worked and communicated
diligently to successfully accommodate this family in
a timely
fashion. Mike
and Cindy Pudlik have been married for nearly 28
years. They are both native Chicagoans and enjoy
their lives in the suburbs. They have three
wonderful children that keep them active at all levels
of the academic spectrum; from middle school to
college. As a family, they enjoy traveling and
camping throughout the United States and attending a
wide range of social and sporting events. Mike
Pudlik volunteers his time on the Executive Board of
NARIGC and serves as Chairperson for Meetings and
Programs. Recently,
Mike has volunteered his construction talents to a
NARI to the Rescue Project for a family residing in
Elk Grove Village. This loving family has four
children, which have special needs. Legacy,

together to renovate the bathroom facilities for this
family in need.
Mike joined NARI because he wanted to be involved with

industry he serves and hopes to build relationships

Not Handing out the "Know
Your Consumer Rights" Brochure? You May Not Be
Entitled to Pursuing Liens!

In another recent
ruling on the Home Repair and Remodeling Act the Third
District rendered a decision in Fandel v. Allen, (3rd
Dist. 3-08-0237) on January 14, 2010. That case
involved a contractor who provided a detailed written
work order that was not signed by the homeowner. The
contractor also admittedly failed to provide a copy of
the Know Your Consumer Rights
brochure. The trial court
held the contractor was not able to pursue a
foreclosure of its mechanics lien based on these
violations of the Home Repair and Remodeling Act. The
Appellate Court reversed and held these procedural
violations of the Home Repair and Remodeling Act did
not render the oral contract illegal or unenforceable
and consequently did not bar enforcement of the
mechanics lien. The
Appellate Court held the Home Repair and Remodeling
Act was not intended to create a private cause of
action enforceable by homeowners or allow affirmative
defenses to otherwise valid contract or mechanics
lien claims. If damaged by violations of the Home
Repair and Remodeling Act individuals may recover
under the Consumer Fraud and Deceptive Business
Practices Act since any violation of the Home Repair
and Remodeling Act is also a violation of the Consumer
Fraud Act and Deceptive Business Practices Act.
This decision appears to
run contrary to prior decisions in both the Third
District and other Districts in Illinois. It would
seem it is simply a matter of time before the Illinois
Supreme Court is asked to resolve these differences.

EPA LEAD REQUIREMENTS
All contractors that work on pre-1978
homes and disturb more than 6 square feet of paint
interior or 20 square feet of paint exterior or engage
in window replacements must be Certified Renovators
by April 22, 2010. These include but are not
limited to renovators, remodelers, plumbers, painters,
electricians, window & door contractors, landlords

Timeline for Lead Rules
Implementation: December 22, 2008: Switch to
"Renovate Right" brochure distribution (instead of
"Protect Your Family") April 22, 2009: "Train the
Trainer" courses begin for those who will teach the
Lead Certification After April 22, 2009: Persons
seeking certification as renovators or dust sampling
technicians may take accredited training as soon as
they are available. October 22, 2009: Firms may
start applying to the EPA for certification to conduct
renovations April 22, 2010: Renovations
in target (pre-1978) housing and child-occupied
facilities must be conducted by certified renovation
firms, using renovators with accredited training, and
following the work practice requirements of the

contractors performing renovation, repair and painting
projects that disturb lead-based paint provide the Renovate Right: Important Lead Hazard
Information for Families, Child Care Providers, and

Español (PDF) (20 pp, 3.2MB) to owners and
occupants of target housing and child care facilities
and to parents and guardians of children under age six
that attend child care facilities built prior to 1978.
The rule will affect paid renovators who work in
pre-1978 housing and child-occupied facilities,
including: - Renovation contractors -
Maintenance workers in multi-family housing - Painters
and other specialty trades. Under the rule,
child-occupied facilities are defined as residential,
public or commercial buildings where children under
age six are present on a regular basis. The
requirements apply to renovation, repair or painting
activities. The rule does not apply to minor
maintenance or repair activities where less than six
square feet of lead-based paint is disturbed in a room
or where less then 20 square feet of lead-based paint
is disturbed on the exterior. Window replacement is
not minor maintenance or repair.
Understand that after April
2010, federal law will require you to be certified and
to use lead-safe work practices. Read more about EPA's
